In order to provide you with more accurate and personalized services, VidAU will use and disclose your personal information in accordance with the provisions of this Privacy Policy. VidAU will handle this information with a high degree of diligence and prudence. Except as otherwise provided in this Privacy Policy, VidAU will not disclose or provide this information to third parties without your prior permission. VidAU will update this Privacy Policy from time to time. Please read carefully the following Privacy Policy, which provides you, as the User of the Sites and/or Products (the “User” or “You”), with the relevant information regarding the various processing of Personal Data implemented by VidAU.
1. Scope of Application
1.1 When you register a VidAU account or generate an API key, you provide the personal registration information required by VidAU (such as name, email, company name, billing address, etc.).
1.2 When you use VidAU network services or visit VidAU platform web pages, VidAU automatically receives and records information on your browser and computer, including but not limited to your IP address, browser type, language used, data such as access date and time, software and hardware feature information, and web page records you require.
1.3 When you call VidAU API Services, VidAU automatically receives and records the Service Usage Data you submit, including but not limited to: timestamps, requested API model version, generation duration, requested input size, output file size, error codes, and for billing purposes.
1.4 User personal data obtained by VidAU from business partners through legal channels.
You understand and agree that the following information does not apply to this Privacy Policy:
a. The keyword information you enter when using the search service provided by the VidAU platform.
b. Violation of legal provisions or VidAU rules and the measures VidAU has taken against you.
2.1 VidAU will not provide, sell, rent, share or trade your personal information to any unrelated third party, unless your permission is obtained in advance, or the third party and VidAU (including VidAU affiliates) provide services to you individually or jointly, and after the service ends, it will be prohibited from accessing all such materials including those it was able to access before.
2.2 VidAU also does not allow any third party to collect, edit, sell or disseminate your personal information for free by any means. If any VidAU platform user engages in the above activities, upon discovery, VidAU has the right to immediately terminate the service agreement with the user.
2.3 For the purpose of serving Developers and Users, VidAU may use your personal information to provide you with information that you are interested in, including but not limited to sending you product and service information, or sharing information with VidAU partners so that they can send you information about its products and services (the latter requires your prior consent). If you wish to cancel the aforementioned purpose, you can contact us or operate through your account or our Sites.
Under the following circumstances, VidAU will disclose all or part of your personal information based on your personal wishes or legal regulations:
3.1 Disclosure to third parties with your prior consent.
3.2 In order to provide the products and services you requested, your personal information must be shared with third parties.
3.3 According to the relevant provisions of the law, or the requirements of administrative and judicial agencies, disclosure to third parties or administrative and judicial agencies.
3.4 If you have violated relevant local laws, regulations or VidAU service agreement or related rules, disclosure to a third party is necessary.
3.5 If you are a qualified intellectual property complainant and have filed a complaint, disclosure to the respondent should occur at the request of the respondent so that both parties can handle possible rights disputes.
3.6 In a transaction created on the VidAU platform, if any party to the transaction fulfills or partially fulfills its transaction obligations and submits a request for information disclosure, VidAU has the right to decide to provide the user with the necessary information such as the contact information of the counterparty to the transaction, to facilitate the completion of transactions or the resolution of disputes.
3.7 Other disclosures deemed appropriate in accordance with laws, regulations or website policies.
The information and materials collected by VidAU about you will be stored on the servers of VidAU and/or its affiliates. This information and materials may be transferred to and accessed overseas in your country, region or the place where VidAU collects information and materials, storage and display (e.g., Singapore or the United States). You understand and agree that the use of our API Services involves the cross-border transfer of your data to the location of our GPU computing clusters (including but not limited to the United States or Singapore) for processing.
5. Use of Cookies
5.1 If you do not refuse to accept cookies, VidAU will set or access cookies on your computer so that you can log in or use VidAU platform services or functions that rely on cookies. VidAU uses cookies to provide you with more thoughtful personalized services, including promotional services.
5.2 You have the right to choose to accept or refuse to accept cookies. You can refuse to accept cookies by modifying your browser settings. However, if you choose to refuse to accept cookies, you may not be able to log in or use VidAU web services or functions that rely on cookies.
5.3 This policy will apply to the relevant information obtained through the cookies set by VidAU.
6.1 VidAU account has security protection function; please keep your username and password information properly. VidAU will ensure that your information will not be lost, misused and altered through security measures such as encrypting user passwords. Despite the aforementioned security measures, please also note that there are no “perfect security measures” on the information network.
6.2 When using VidAU network services for online transactions, you will inevitably have to disclose your personal information, such as contact information or postal address, to the counterparty or potential counterparty. Please properly protect your personal information and only provide it to others when necessary. If you find that your personal information is leaked, especially if your VidAU username and password are leaked, please contact VidAU immediately so that VidAU can take appropriate measures.
7. Duration of the Storage
VidAU will store the collected Personal Data for the duration necessary for the fulfilment of our contractual relationship or legal obligations and permitted by applicable legislation. Beyond this duration, we will delete the Personal Data according to applicable legislation. In order for VidAU to be able to demonstrate the existence of a right or a contract or a legal obligation, the relevant Personal Data will be stored through intermediary archives for a duration that will not exceed what is strictly necessary regarding the purpose of the storage and in accordance with the applicable legislation.
VidAU’s Sites and products are not intended for use by children under the age of 16 and we do not intentionally collect any information from users under the age of 16. If you do not meet applicable age requirements, please do not use those Sites and products. If a parent or guardian becomes aware that their child has provided VidAU with Personal Data or that we have otherwise inadvertently collected this information, please contact us at: [email protected], so that we may delete the information from our servers.
9. Special Notes on API Data Processing and Model Training
This section details how we process data transmitted via API calls as an API Platform.
9.1 Data Collection and Use
- Service Log Information: We collect your device and log information. Device information (such as device model information) and log information (referring to service logs generated when you use a service) are generally used for purposes including identifying standalone devices, preventing cheating, and determining whether an account is secure.
- Inference Data Processing: When you submit images, text, or audio (“User Input”) via the API to generate video (“User Output”), the processing of this data is transient and instantaneous, used only to execute the Inference process.
- Data Use Purpose: The purposes for collecting and processing User Input and Output only include: providing the requested video generation services, billing, fraud prevention, identifying and resolving API errors.
9.2 Model Training Policy
We will not use the User Input and User Output you submit via general API calls to train or improve our foundation AI models, unless: a. You explicitly choose to opt into a service that requires the use of data for custom model training (e.g., custom AI avatar services), in which case, that service will be governed by separate contractual terms and privacy consent. b. The data is anonymized and de-identified aggregated service usage data, and is used solely for the maintenance and general performance optimization of the service itself.
10. Revision of this Privacy Policy
Occasionally, we may change this Privacy Policy (or other documents related to the Privacy Policy) to allow VidAU to use or share your Personal Data in a different way. If we do, the links to the policy on our Sites will indicate that the policy has been changed. We encourage you to periodically review the Privacy Policy for the latest information on our privacy practices.
